Terms and Conditions

Please read through our Terms and Conditions, we ask that you do not use our website or service until you have familiarised yourself with them. If you are using or have used our service it is understood that you have agreed to the terms set forth on this page.

When we say “We” “Webfox” “Webfox Design” “Webfox Website Design”, “us”, “our” and “our service” we are referring to The Webfox Design and its respective products and services. References to “you” “your” “customer” “client” and the like, refer to you, and your agents. These Terms and Conditions can change at any time. It is important that you check back here regularly. Your continued use of this website and our services implies acceptance of any subsequent revisions.

You must read, agree with and accept all of the terms and conditions contained in this Terms of Service agreement and Webfox’s Privacy Policy before you may become a Webfox user.

1. Communication

1.1  General Communication
Email contact is preferred where possible, as it provides written documentation of requests from both parties. Notes will be taken during any face-to-face or phone meetings, and a copy will be forwarded to the client within 24 hours of the conversations.

1.2  Urgent Contact
If the matter is extremely urgent, please call 0487 404 284 or send a direct Facebook message to Webfox Design (m.me/webfoxdesign). Whilst we will do all in our power to respond straight away, we cannot guarantee that your message will be dealt with immediately.

1.3  Phone or Face-to-Face Meetings
Phone or face-to-face meetings can be scheduled via email (hello@webfox.net.au or emelyn@webfox.net.au), or by Facebook messenger (m.me/webfoxdesign) and must be organised with at least 24 hours notice. Face-to-face meetings will require a callout fee which will be quoted and invoiced separately.

1.4  Expectations
We pride ourselves in our attention to detail. Our promise to you is that we’ll deliver work of a high standard and in a timely fashion. During the development stage, we will keep you informed as to the progress of work, and when to expect tasks to be completed. In the rare case that a deadline may not be met, we will keep an open dialogue so you are aware of what is going on.

1.5  Design requests from live website clients

  • We allow for between 3 to 5 business days to provide a quote.
  • From approval and deposit payment for work, completion will take a minimum of 5 business days.
  • Depending on the complexity of the work, the designer will be able to let you know an estimated completion timeframe at the outset, if you wish. As estimations, they are subject to change.
  • For quicker turnaround requests, we will charge an expedited premium on top of the quote for the work itself.
  • Quotes are valid for 10 business days from the date sent by TWS.

2. Project Stages

2.1  Stage One
We will begin to discuss, design and develop your website. You can access the development version of your website via a temporary password-protected URL (World Wide Web page address). We will also load any content (text and images) that you have supplied to us. If you have not supplied any content during this stage, we will load placeholder (dummy) content to assist in the visualisation of the design.

2.2  Stage Two
At the completion of stage one, we will submit the design to you for approval. Please note that dummy content may still be visible, if we have not received the live content from you. Once approved, we will begin browser testing on your website, and finalising content for each page. If applicable, we will also setup any upgrades you have purchased, such as online stores or membership services. (Please refer to section 6 and 7 for details of these stages)

2.3  Stage Three
We will submit your completed website to you for final approval. Once approved, we will setup your official, live URL and begin your monthly hosting and maintenance subscription with Webfox. (Please refer to section 8 for details of these stages).

We make every effort to launch your site onto your domain name on the date you request when approving your website but we do not offer a guarantee. If we are not able to launch on the day requested we will inform you prior to the date and arrange an alternative launch date.

3. Payments and Pricing

3.2  Stage One Payments
Prior to commencing work we must receive a minimum $200 deposit for your website project.

3.3  Stage Two Payments
Upon approval of your website design, we will request any remaining setup and/or one-time fees to be paid in full.

3.4  Stage Three Payments
Upon completion of the finalised website design, we will begin charging you a monthly hosting and maintenance fee. This fee will be charged to your credit card at 30 day intervals, indefinitely, until we receive a cancellation notice.

3.5  Pricing
Webfox has the right to alter pricing at any time. Before doing so, notice will be given to you. Your continued use of our services implies an acceptance of the new pricing.

4. Payments

4.1  Deposits and One-Time Fees
Invoices for deposits or one-time-fees will be emailed to you. A record of all invoices will be recorded in your Webfox Billing Account. We will supply you with a username and password for this account at the start of your project. Accepted payment methods for deposits and one-time-fees include bank transfers or credit cards. All prices are quoted in Australian Dollars. Payments for these invoices are due within 21 days from the date of issue. Late payments can incur fees of up to 1.5% per month.

4.2  Additional Fees
Additional fees for extra design work or technical features will be quoted and invoiced separately.

4.3  Hosting & Maintenance Subscriptions
Live Webfox Websites require and ongoing Hosting & Maintenance subscription. (Refer to section 8 for details on this service). An active credit card is required for this subscription. Payments for this service will be charged to your credit card at one month intervals, with the applicable rate.

Invoices and receipts for subscriptions can be accessed online in your Webfox Billing Account. Hosting & Maintenance subscription prices are subject to change.

4.4  Failed Payments
If a credit card charge fails, we won’t deactivate your account straight away. We’ll contact you ASAP and attempt to charge the current card 2 more times over 2 days.

However, if payment hasn’t been resolved within 7 days from the failed transaction, then your website will be deactivated. This means it will be removed from public view, and only Webfox will have access to it.

If payment hasn’t been resolved after 28 days from the failed transaction, then your website will be permanently removed, unless other arrangements have been made.

5. Refunds

5.1  Deposits and One-Time Fees
You will be eligible for a complete refund of your project value if no work has commenced on your project from when we receive payment of your deposit, to when we receive notice in writing that you are cancelling your website project and request a refund.

5.2  Hosting & Maintenance Subscriptions
We cannot refund any fees already paid by you, unless we fail to deliver our services as outline in section 8 of this document.

6. Cancellation of Services

6.1  Cancellations During Stage One and Stage Two of a Project
Cancellation requests must be made in writing. You will be eligible for a complete refund of your project value if no work has commenced on your project from when we receive payment of your deposit, to when we receive notice in writing that you are cancelling your website project and request a refund.

6.2  Hosting & Maintenance Subscriptions
You can cancel your subscription instantly by logging into your Webfox Billing Account. No exit fees or cancellation fees will be charged. We cannot refund any fees already paid by you, unless we fail to deliver our services as outline in section 8 of this document. Your website will be removed within 24 hours of your subscription cancellation. Webfox is not obligated to keep a copy of your website and website files, should you decide to cancel.

6.2  Reactivating Cancelled Services
Reactivation requests must be made in writing. A reactivation fee may apply, these fees will be quoted and invoiced separately. Webfox is not obligated to keep a copy of your website and website files, should you decide to cancel.

7. Website Content

7.1   Stock Images
If we use stock imagery on your website you do not own these images, ownership is retained by the image rights owner. Such images can therefore not be used or re-used for any other purpose and can only be used as they were placed onto your website by us. Any editing of the dimensions in which they appear may contravene their usage rights. Do not copy the images and use them in other promotional materials. If you are looking to own the images on your website or use them for another purpose then please contact us and we will endeavor to put you in contact with the image rights owner. This of course, does not apply to images that you own and provide to us for use on your website.

7.2  Client Supplied Images
Were possible, client-supplied photographs and graphics should be sent in an acceptable high resolution digital format. In the interest in maintaining a high standard of work, we do reserve the right to exclude (or heavily modify) images that do not meet quality expectations. In the case of logos or vector objects, a re-draw fee may be applicable if the quality is too low. 

7.3   Client Supplied Text
Any text you require to be added to the website must be supplied as a text-based format (email, word document, text file or similar). Whilst we do take care to ensure spelling and grammar is correct, we can’t take responsibility for any incorrect spelling/grammar or information, if it appears incorrect on the source material.

If you are only able to supply photographs or scans of hand-written notes, a small fee will be required to type up these notes.

7.4  Usage Rights
Webfox can’t be held liable for any copyright infringements that come from text or images you supply to us. We also can’t be held liable for any damages caused as a result of misinformation that your supply to us. We do not vet material that is supplied to us.  Please ensure that you have the correct permissions to use the images and text that appear on your website.

7.5  Acceptable Content
Webfox websites can not be used to disseminate, communicate, store or transmit:

  • content sexually-explicit in nature;
  • information that contains virus’, worms or malicious elements;
  • Copyright infringing data;
  • trade secret protected data;
  • data that infringes on any intellectual property, publicity rights or privacy rights;
  • is defamatory, harassing or threatening;
  • relates to illegal business operations or schemes;
  • contains deliberately misleading, incomplete or deceptive content; or
  • is deemed inappropriate by Webfox

8. Browser Testing

8.1   Desktop Version
We will test the appearance and usage of your website in the following browsers:

  • Google Chrome
  • Microsoft Explorer
  • Mozilla Firefox

We won’t test in other browsers unless agreed separately. If you need us to test using other browsers, we can provide a separate estimate.

8.2  Tablet and Mobile Versions

Testing using popular smaller screen devices is essential in ensuring that a person’s experience of a design is appropriate to the capabilities of the device they’re using. We test our designs in:

  • iOS: Safari and Google Chrome
  • Android: Google Chrome

We won’t test in Opera Mini/Mobile, specific Android devices, or other mobile browsers unless we agreed separately. If you need us to test using these, we can provide a separate estimate.

9. Maintenance, Updates and Content Management

9.1   Ongoing Maintenance and Hosting Subscription
Your monthly maintenance and hosting fees include:

  • An active account for domain name and website hosting. Details of all third party providers can be accessed on request.
  • Continuous updates to WordPress plugins and core files as necessary
  • Daily backups stored on your server. Each backup will be stored for 3 days.
  • Technical support for website issues
  • Content management service for basic updates to text and images (as outlined below)

9.2  Content Management Service
Upon completion of your website, you will receive documentation on how to make basic updates yourself. If you prefer, Webfox can manage these basic updates for you at no extra cost. The following scenarios are classed as basic updates:

  • Replacing an existing image with a new one. Limited to 5 images per month. Additional work will be quoted separately.
  • Adding a new image to an existing page. Limited to 5 images per month. Additional work will be quoted separately.
  • Editing existing text that appears on a single page. Limited to 5 edits per month. Additional work will be quoted separately.
  • Adding new text to an existing page. Limited to 5 additions per month. Additional work will be quoted separately.
  • Editing an existing product category (applicable for E-Commerce Website only). Limited to 5 product categories per month. Additional work will be quoted separately.
  • Creating a new product category (applicable for E-Commerce Website only). Limited to 5 product categories per month. Additional work will be quoted separately.

The following updates are not classed basic updates, and work will be quoted and invoiced separately:

  • Adding new pages to the website
  • Creating advertising banners to include on the website or social media accounts
  • Adding custom slideshow slides
  • The creation of a new online contact form
  • The creation of a new photo gallery
  • Creating new products (applicable for E-Commerce Website only)
  • Any other work that requires custom graphics to be created

9.3  E-Commerce Content Management
If you plan on selling products online and have selected the E-Commerce Website option, then we will supply you with documentation on how you can manage your inventory. This includes creating new products and how to process orders. Please contact us if you would like more information.

9.4  Additional Work
Additional design or technical work is billed at a rate of $60/hour. These items will be quoted and invoiced separately. Out rate is subject to change.

10. Technical Support

10.1  General Support
Should you encounter any problems with your website, please contact us and we will resolve the matter as soon as possible. Occasionally, issues may be caused by the third-party hosting provider. If this is the case, we will liaise with the hosting company and keep you up-to-date with the resolution.

10.2   Urgent Support
If the matter is extremely urgent, please call 0487 404 284 or send a direct Facebook message to Webfox Design (m.me/webfoxdesign). Whilst we will do all in our power to respond straight away, we cannot guarantee that your message will be dealt with immediately.

11. Hosting, Domain and Email Services

11.1   Hosting Account
Your live website will be hosted with the third party provider, SiteGround. Any websites not hosted with this provider will be transferred to SiteGround on your behalf. Your website plan includes 1 Website and 10GB of web space. Any additional information on this plan is available on request. 

11.2  Domain Name
The domain name linked to your live hosting account will also be registered through, or transferred to SiteGround on your behalf.

11.3  Email Accounts
Your account with SiteGround offers unlimited email addresses, with 2GB storage per address. Email storage upgrades are available, and will be quoted and invoiced separately.

11.4  Amending Hosting, Domain or Email Services
Occasionally, Webfox will need to liase with the third party proiver on your behalf. Any changes that involve billing will be submitted to you first in writing for approval.

12. Intellectual Property

12.1   Ownership
The system that runs your website remains the property of Webfox at all times. The coding, programming and intellectual property that creates your website is owned by Webfox. In proceeding and paying in whole for a website project with us you own the style, design and graphic design of the website. You also own all of the content that you place onto your website. The content, style and design on your website will be made available to you if you elect to leave The Web Showroom.

13. Promotional Material

13.1   Webfox Advertising
Webfox reserves the right to use client websites, web designs, layouts, prototypes, wireframes and collateral in advertising and / or marketing initiatives. This may include portfolio examples on our website, case studies and other promotional initiatives.

14. Privacy

14.1   Your Privacy
Your privacy is important to us. We will never sell, lease or distribute your contact details to any 3rd party. We will only reveal data pertaining to your account if compelled to do so by law. Details on data collection and usage can be found in out Privacy Policy statement.

15. Our Service Rights

15.1   Competitors
Webfox reserves the right to provide its services to your competitors, and makes no promise to work with you exclusively in any particular market area. While we may work with your competitors, we will never share or sell your confidential information, or information about your business.

15.1   Termination of Services
Webfox reserves the right to terminate services without notice, if you are in breach of these terms and conditions.
